Ex Post Facto Laws Essay
Ex present facto laws allude on laws that apply to acts submitted before the order of such laws and are, in this way, disadvantageous to the influenced people. The United States constitution in article I, area 10 restricts the state from ordering such retroactive laws. This disallowance shields people from low authoritative acts. In any case, the prohibition on ex post facto laws applies just with respect to criminal and not common laws (Zollar, 2002). I accept that the US constitution is sensible and predictable by containing arrangements that limit the establishment of ex post facto laws since this assistance in shielding the privileges of people under existing laws. On the off chance that the constitution didn't contain the ex post facto statement, people would be unreasonably exposed to laws that demonstration retrogressively and deny them equity. For example, a grown-up ought not be indicted for wrongdoings he carried out when he was a minor if such violations couldn't be initia ted against him around then because of confinement on adolescent court purview. I agree with the creators of the ex post facto provision that laws ought not be applied retroactively. Be that as it may, where the standard can't be sensibly applied, different exemptions ought to be fused to make the standard useful. Like each other standard, I accept that it is significant for the ex present facto proviso on have different exemptions that would guarantee its enforceability. While I concur that laws ought not be established retrogressively, I feel that the greatest test confronting the ex post facto proviso is the dark separation of criminal laws from common laws. The condition that restricts ex post facto laws bans a few demonstrations. To begin with, it precludes the making of criminal laws and making them retroactive. Such retroactive laws have the impact of condemning acts submitted before their institutions. The proviso likewise denies laws that are made so as to retroactively irritate a wrongdoing, for example, by retroactively changing an offense to a crime. Retroactively expanding the discipline for a wrongdoing is additionally restricted under US laws. Besides, the Ex post facto condition likewise bans the formation of laws that adjust the guidelines of proof and rather permit conviction dependent on various or lesser proof than what the law banished at the hour of the crimeââ¬â¢s commission (Gardner and Anderson, 2011). There are a few exemptions to the restriction of retroactive laws in the ex post facto condition. The standard is constrained to corrective law and isn't pertinent to situations where the new laws favor the charged. Additionally, the standard isn't relevant to standard laws and point of reference laws that are review concerning past cases. Another exemption to the ex post facto rule is a retroactive law that accommodates retaliation for specific acts that were illicit however not criminal when they were carried out. A case of such a law is the London Agreement, which is retroactive to the degree of acts that established infringement of universal laws when they were submitted (Bassiouni, 2011) One of the most significant current parts of ex post facto laws is tax assessment. Restriction of retroactive laws is constrained to criminal acts. Subsequently, there is no ex post facto law restriction in tax collection since it is a common demonstration. On account of Fernandez versus Fernandez, it was decided that forbiddance on ex post facto laws was constrained to criminal laws and that charge laws were urban. In September 2012, the U.S Commerce Department forced an ex post facto expense of $ 100 million as an enemy of dumping measure (Foldvary, 2012). I feel that there is have to address the absence of forbiddance of ex post facto laws in tax assessment. It would be treacherous if business people would lose property through appropriation by the administration with an end goal to recoup retroactive charges. References Bassiouni, M. C. (2011). Multistate Health Corporation Management
Case Analysis: Strategic Planning at Multistate Health Corporation The MHCââ¬â¢s system as far as market position is to embrace the new innovation for effective and proficient wellbeing administration conveyance at a lower cost than other wellbeing specialist organizations in the market. It targets improving proficiency as far as administration arrangement to the less blessed individuals from the network just as outpatient services.Advertising We will compose a custom coursework test on Multistate Health Corporation Management explicitly for you for just $16.05 $11/page Learn More Therefore, it targets charging same costs as other wellbeing specialist organizations yet utilize productive innovation and proficient assistance arrangement to eliminate clinic costs by lessening persistent recuperation periods to acquire benefits. It likewise means to advertise the innovation to other wellbeing specialist organizations to procure incomes. MHC is working in a serious outside condition w here costs are controlled by bureaucratic state governments. The earth is serious with changes in items and administrations subsequently requirement for new serious methodologies. The new techniques coordinates the earth in a manner that MHC will out contend its rivals from the advantages of new innovation and the productivity in administration arrangement because of decrease in clinic costs (Blanchard, Thacker, 2009). MHC as of now utilizes a decentralized structure whereby its branches work as independent benefit arranged elements with liberation of reports to the focal administration. Under the serious system proposed, the current structure must be changed in accordance with a progressively incorporated structure so the auxiliary enterprises can fit uniform usage of the technique to all the areas and divisions.à Some of the basic changes that ought to be made incorporate the accompanying. Centralization of activities on the grounds that the current framework doesn't give great c ondition to organizations between the auxiliary companies and the districts, getting the correct staff to complete the usage, harmonization of the entire framework to have the option to call attention to the dispersed faculty with capacities to execute the new serious procedure and changes in accordance with the human asset framework to think of a reasonable HR framework that will fit the correct work force in the correct spots (Blanchard, Thacker, 2009). One zone where the board KSAs isn't lined up with viable usage of the serious procedure is the assessment and examination of the KSA expected of the administration in various divisions. There are no frameworks for doing this since the administration in various divisions has various obligations and none of them thinks about these differences.Advertising Looking for coursework on business financial aspects? Information assortment is manual and assessment of execution is conflicting and this represents a hazard to determination of able administration to actualize the serious methodology (Blanchard, Thacker, 2009). MHC should think of a blended HRPS that will characterize the duties of the administration and data gave to the entire association with the goal that pioneers may realize their job just as that of their partners. The framework will likewise guarantee powerful assessment of the exhibition of the board so compelling directors can be picked upon to actualize the serious systems (Blanchard, Thacker, 2009). Given the usage obligation, I would suggest that the arranging group change the current decentralized structure to a progressively brought together structure so as to improve the choice and filling of empty positions, build up a progression plan that will make an interpretation of the old framework to once more frame work, figure and distinguish the basic aptitudes just as capacity needs and inadequacies for procedure execution and think of an advancement framework that will improve the vocations of organizationsââ¬â¢ representatives through preparing and in-administration arrangement. The entirety of the above ought to be equipped towards accomplishing the crucial the association (Langbein, 2007). The HR unit should ensure that data about work power availability to execute the serious system is accessible and all around refreshed. It ought to likewise give contribution to request to deal with any progressions that may emerge following the headings of the new system. It ought to guarantee that suitable HRIS in set up to unite the representatives information over all the divisions for assessment and settlement purposes. The HRD should ensure that the work power to execute the methodology is all around created and outfitted with the information and aptitudes through compelling preparing (capaci ties). Be that as it may, since abilities of work power alone can not prompt great execution, it is fitting for the HRD to interface with OD (whose obligation is to oversee execution) so as to concoct extreme accomplishment in the new system usage. A blend of execution the board and capacities of laborers prompts accomplishment in technique usage (Langbein, 2007).Advertising We will compose a custom coursework test on Multistate Health Corporation Management explicitly for you for just $16.05 $11/page Learn More References Blanchard, N. Reasons You Can Be Denied a Firearm Transfer
Reasons You Can Be Denied a Firearm Transfer Since the entry of the Brady Handgun Violence Prevention Act of 1993, any individual who buys a gun in the United States must submit to a record verification to decide whether they are qualified to purchase and have a firearm. Authorized weapon sellers must check every individual who attempts to purchase a gun through the FBIs National Instant Criminal Background Check System (NICS). At the point when a forthcoming purchaser needs to buy a gun, they should initially furnish the seller with photograph recognizable proof and a finished Firearms Transaction Record, or Form 4473. On the off chance that the purchaser answers yes to any of the inquiries on Form 4473, the seller is required to deny the deal. It is a felony,â punishable by as long as five years in jail, to lie while finishing the structure. In the event that the purchaser qualifies, the seller will at that point demand a NICS check. The NICS has three business days to either support or deny the deal. On the off chance that the three days go without a NICS assurance, at that point the vendor can process the offer of the gun (contingent upon nearby laws) or hold up until the NICS reacts. All things considered, just around one percent of guns moves are denied by the NICS framework, principally in light of the fact that most sentenced hoodlums definitely realize they are not qualified to possess a weapon. Restrictive Criteria for Firearm Transfers Under government law, there are explicit reasons that a gun move can be denied. In the event that you have had a gun move denied, it is on the grounds that you or another person with a comparative name or graphic highlights has ever been: Sentenced for a felonyConvicted in any court of a wrongdoing which isâ punishable by a term of over one year or a crime deserving of over two years. This is the main motivation behind why demands for gun moves are denied.Indicted for a wrongdoing deserving of more than one yearA criminal from justiceA client of unlawful medications or an addictInvoluntarily perpetrated to a psychological institutionAn illicit alienDishonorably released from the furnished forcesRenounced your U.S. citizenshipSubject to a controlling request for undermining a family memberConvicted of household violenceUnder anâ indictment, yet not indicted, of a wrongdoing conveying a potential year-long jail sentence State Prohibitions The NCIS can likewise deny a gun move dependent on any relevant state laws. For instance, if your state has a law disallowing the ownership of a particular sort of gun, the NICS can deny your exchange despite the fact that ownership of that gun isn't restricted by government law. The Brady Law was intended to ensure that solitary well behaved residents can buy and own guns, yet pundits guarantee that the law just made a tremendous underground market interest for unlawful firearms deals to crooks. NCIS Accuracy In September 2016 the Department of Justices Office of the Inspector General played out a review to check the FBIs quality control of NICS exchanges. They chose 447 denied exchanges and found that just a single exchange was inaccurately denied, which brought about a 99.8 percent exactness rate. Next, the reviewers took a gander at records that the FBI had denied the exchange inside three business days. Out of 306 records picked haphazardly, 241 were handled by the FBI properly. Notwithstanding, six of the exchanges were denied inside by the FBI, however the forswearing was not imparted to the vendors from one day to over seven months after the refusal. Examiners additionally discovered 59 exchanges which the FBI endorsed, yet ought to have denied. The FBIââ¬â¢s quality control checks got and revised 57 of these blunders as a piece of its inside controls. Engaging a Firearm Transfer Denial In the event that you attempt to buy a weapon and youâ receive a guns move refusal during the record verification, youâ can bid that disavowal on the off chance that you don't meet any of the above rules and you accept a mix-up has been made. Around, one percent of guns moves are denied and commonly it on account of mixed up character or wrong records at NICS. In this manner, numerous guns move forswearing bids are fruitful. How to Write Illegal Immigration Essay
How to Write Illegal Immigration Essay Immigration has always been a painful issue, and in light of the recent U.S. events, it is becoming even more urgent. The Syrian refugees, the travel ban imposed by the Trump administration, the aggravation of racism-based attacks â" all of these make immigration an unavoidable topic of discussion and, in case of college students, academic writing. You are quite likely to be assigned to write an essay about illegal immigration, and if you have, you should make efforts to approach it right. Key difficulties when writing an illegal immigration essay To better prepare for writing the paper, you should first understand what you are getting yourself into. Immigration is a rather widely discussed topic, so writing it will unavoidably be connected with some major difficulties. Opposing points of view As with almost anything in politics, you canât really stay in the middle and prevent yourself from taking any side. The experience proves that people canât tolerate political views opposed to their own â" at least, in most cases. Thatâs why by writing this essay you should be extremely careful in order not to offend the feelings of your readers. Even the most unbiased of professors might start taking your arguments with a grain of salt if you go against what they believe to be right. A diverse issue that requires research You canât be just for or against immigration, because there are so many aspects to it. If it was simple, the debate surrounding it would not be so heated. If you are proposing something in your essay about illegal immigration, you will have to do extensive research about the appropriate legislation and practices. Any surface assumptions will not be taken seriously, thatâs for sure. Prepare yourself for some digging. The danger of losing the human touch In distancing yourself from the problem of people who are immigrating illegally, you run the risk of losing what it takes to solve the issue effectively â" the human touch. Itâs easy to just close borders and forbid any kind of immigration, excepting a few selected people every year. But there are reasons why people choose to abandon their homes and live illegally in another country. There are wars and political oppression, for example. What are refuges â" should they be considered legal or illegal immigrants? There are so many sides of the immigration issue itself, that you could never use the one-size-fits-all approach. Angles to consider If you havenât been assigned a question to answer in your illegal immigration essay, then you will have to come up with an angle on your own. Being a diverse issue, illegal immigration offers plenty of opportunities. The âfor and againstâ kind of paper will be too general and thus wonât offer any actionable measures. Here are but a few of the more specific angles you could use in your paper: Legislation The legislation area is admittedly rather wide, but it doesnât mean you canât focus on a legal act or two. You can analyze it and then propose ways to improve it to better reflect the modern realities of illegal immigration. Please note that in this approach, you will have to take into account international legislation as well, not only the U.S. laws. The Dreamers Dreamers are youth that have grown up in the U.S., having been brought to the country by their parents. Strictly speaking, they are illegal immigrants. In reality, however, they havenât known any other home country beside the U.S. Thatâs why deporting them is a cruel measure. Up until recently, such people were protected by the Dreamers Act, which let them get education and then employment on legal grounds. The Trump administration, however, revoked the Act, affecting thousands of students all over the U.S., provoking outrage in academic circles. The very phenomenon of a person who has been brought to the country illegally but grew up as a full-fledged citizen is one worth studying. The Trump Wall Nobody expected the wall project to be a real one, and yet Mr. President is making it happen. What are the implications of erecting such a structure on the U.S. border? Does it have any real-life value and how will it influence the relationship between the U.S. and its neighbors? Is the wall project feasible in modern realities? The reasons of illegal immigration When you write an essay about illegal immigration, search your memory for people you know that have left their home countries to live in the U.S. illegally. Why did they do it? What forced them out of their homes? Was it the desire to live a better life or something more sinister like a war or oppression? The stories of real people can help paint the general picture. Maybe if some of the factors causing illegal immigration could be addressed by governments of other countries, the flow of immigration to wealthier countries could be reduced. General recommendations on how to write an essay about illegal immigration As any other paper, this one should follow best practices of the academic writing area: Extensive research of relevant sources In your essay illegal immigration should be studied rather deeply, at least the aspect of it that you are writing about. Thatâs why youâll need to spend plenty of time going over the sources. Without it, the paper wonât be comprehensive enough. Luckily, the immigration being a widely discussed issue, you shouldnât have any problems finding all kinds of information. A well-established, debatable thesis statement In your essay illegal immigration thesis statement should be one that fits all the established criteria. It should be specific enough to allow research in the scope of your paper. It should be broad enough to cover all sides of a certain aspect. It should be debatable and provable. And finally, it should be urgent, i.e. relevant to modern realia. Appropriate structure Any paper that aims for a high grade should be structured according to the rules established by your college or university as well as follow general writing guidelines. Most papers follow the regular 3-part structure, where the thesis statement belongs in the introduction, body paragraphs are intended for arguments, and the conclusion summarizes what has been said. In any case, consult your prompts and relevant writing guides. Appropriate citation and formatting Any paper should follow the established rules of citation. Otherwise, it will qualify as plagiarism. Find out the style you are supposed to follow and then download the latest style guide to make sure all the norms are met. Alternatively, you can use an online citation tool, just make sure it relies on the latest norms.

My Impressions From Uncle Toms Cabin - Free Essay Example
The book that was once said to have been the cause of the civil war, has become one of the most important historical books in its time and for many reasons rightfully. It brought light to a very controversial topic at that point in time known as slavery. Throughout the book, one can see slavery portrayed as one of the worst things to ever come in touch in humanity. It made people wonder how it was possible to treat other human beings as horribly as they were treated. The conditions that slaves had to live in day in and day out were unbearable, and no matter what they had to live with this, it was their destiny all because of a factor they could not change, the color of their skin. From the very beginning of the book, the reader can see examples of how slaves were treated poorly. The harsh treatment of slaves included, but was not limited to, being forcefully removed from their families, working for little or no pay, being worked to a point past exhaustion, and harsh punishments. In the book, scenarios, where slave owners are kind to their workers, are present but things do change, and one comes to the realization that having a caring owner was something scarce. à When the book first begins, readers were introduced to the main characters, and they were given some background information. The book consists of one central family that has slaves on their land, but these slave owners are not like most, this family is uncommonly kind and treat their slaves with some dignity. Readers then find out about a major problem with Mr. Shelby and are heartbroken along with Mrs. Shelby when the master is forced to sell two of his salves. Mr. Shelby tried his hardest, and we can see this in page 10, to keep the slaves the trader wanted, and this is evident when he says, I would rather not sell him the fact is sir, Im a humane man, and I hate to take the boy from his mother sir.à The master had some sympathy that other slaves owners might not have dared to show, for they saw their slaves as nothing but property, and on page 10 Haley says to Mr. Shelbyà this kind o trade is hardening to the feelings; but I never found it so,à but by showing the att achment that the master and his wife had to most of their slaves, the reader cannot help but be devastated when the deal is done and signed. Although the family that owns the slaves that were already introduced in the first few chapters seemed like the ideal family to be bought into, things quickly take a turn for the worse. By writing about a scenario such as this one, Harriet Beecher Stowe made sure to let all the readers know that there is no way slavery could be right. No matter how good the slaves were being treated by their masters, there was nothing that could justify the laws of slavery. Harriet Beecher Stowe made this very clear when she used Mrs. Shelby to express this on page 51, This is Gods curse on slavery! I was a fool to think I could make anything good out of such a deadly evil. It is a sin to hold a slave under laws like ours It was evident from as early as chapter five that Beecher Stowe did not believe that any part of slavery was right or could ever work out. She knew that something had to be done and whether she meant to or not she caused a revolution by shining such a bright light on an issue affect ing the nation as a whole. à As a reader, it is very shocking to see that such a young character such as Eva can make such an impact. By putting in the child and her point of view, the readers perspective is introduced to something not often heard about. Eva had been raised with servants her whole life practically, and her family was wealthy enough to buy some of the best slaves in the market, and she had also been brought up getting anything she wanted, and when she lost something, it was quickly replaced. Regardless of every privilege she had, Eva remained such a humble character, and it was easily seen when she was felt love for all of the servants in her home. She felt, too, for those fond, faithful servantsthe things she had witnesses of the evils of the system under which they were living had fallen not the depths of her thoughtful, pondering heart. She had vague longings to do something for them, to bless and save not only them, but all in their condition (Beecher Stowe, pg. 407). In the same chapter , Miss Eva talks about the inhumane things she saw on the boat. Clearly, the things she saw were horrifying to her as a child that she was willing to die if she could put an end to the suffering the servants everywhere were dealing with. She knows that not every slave owner is as kind as her and treats their people with how her family treats her slaves. She sees that other poor creatures have nothing but pain and sorrow, all their lives; -it seems selfish (Beecher Stowe, pg. 410). It troubles Eva not to know how to end the epidemic she had seen. She longs for a solution to the brutal treatment of the human beings of different skin color. à Lastly, Tom is sold to one more slave owner who is not as kind as two of his previous masters. The new man in possession of Tom did not hesitate to discipline his slaves and saw them as nothing more than a piece of property. The sad reality though, was that most slave owners were not much different than Legree. The majority of slave masters would not hesitate for one second to end the life of a disobedient slave. Legrees way of handling his people was very atrocious and cold-blooded. However, at that point in history, all of it was acceptable. Scenes of blood and cruelty are shocking to our ear and heart. What man has nerve to do, man has not nerve to hear And yet, oh my country! These things are done under the shadow of thy laws! (Beecher Stowe, pg. 613). à The casualties caused by slavery affected hundreds of families. Slavery created the separation of families, the abuse of women and children; men were overworked with little to no pay and severe punishments. Harriet Beecher Stowe did a fantastic job by creating such a touching storyline. The readers get attached to the characters in the story hoping that they get the freedom they long for. Stowe was able to display the unfortunate events that were part of slavery in such a vivid way, and I believe this was what inspired Americans nationwide to take a stand and defend what was right. People living in the north might have had no idea of the cruel lifes slaves were living but when this book was published the truths became revealed, and this caused outrage and for an excellent cause. After reading this book, a reader feels inspired to make a change for the sakes of the characters in this book which would have given anything to make the United States a free nation.
